In Montgomery v. Caribe Transport II, LLC, the Supreme Court ruled unanimously that state-law negligent-hiring claims against freight brokers are not preempted by federal law. The decision opens the door to those claims in courts across the country — and the practical fallout for contracts, vetting standards, and underwriting is already underway.
